GIVEAWAY TERMS AND CONDITIONS
ABOUT THE GIVEAWAY:
Welcome to the Giveaway Contest (hereinafter referred to as “Giveaway”)! The Giveaway is sponsored by Wild Ride Silver LLC (herein after referred to as “Company”). The Giveaway is available for your participation only upon your acceptance, without modification, of the terms, conditions, and notices contained herein (the "Terms"). By using the Site and participating in the Giveaway, you signify your agreement to all such Terms. Please read these terms carefully, and retain a copy for your reference.
All participation in this Giveaway is governed by these Official Terms and Conditions. By participating, you fully and unconditionally agree to be bound to and accept these Terms and Conditions and any additional terms and conditions specific to the Giveaway communicated by the Company, and you agree to be bound to the decisions of the Company and its authorized representatives, which are final and binding in all matters. By entering the Giveaway, you agree to be contacted by the Company with Giveaway related communications.
ELIGIBILITY:
The giveaway is open to legal residents of any state in the United States where such giveaways are permitted by law, who are at least eighteen (18) years of age or older at the time of entry (“Participant”). Employees, officers, directors, and immediate family members of Company and its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not eligible to participate in the giveaway. No use of robotic, automatic, programmed, or similar entry methods will be allowed.Entries that do not fully comply with all requirements stated in these Official Terms, included but not limited to providing all required information, will be considered incomplete and will be disqualified. Entries from persons who are not eligible to win per these official rules will also be disqualified.
Company reserves the right in its sole discretion to disqualify any individual who:
ANY ATTEMPT TO DELIBERATELY DAMAGE AS A PARTICIPANT OR OTHERWISE ANY WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
This Giveaway is void where prohibited or restricted by law.
AGREEMENT TO OFFICIAL RULES:
By participating in the giveaway, entrants fully and unconditionally agree to and accept these Terms and Conditions and the decisions of Company, which are final and binding in all matters related to the giveaway.
GIVEAWAY PERIOD:
The giveaway begins on Tuesday December 12th at 9am and ends on Sunday, December 17th at 9pm ("Giveaway Period"). All entries must be received during the Giveaway Period to be eligible for consideration.
HOW TO ENTER:
Step 1: Follow @wildridesilver on Instagram
Step 2 : comment on, save, like and share posts and reels - applies to all posts throughout the Giveaway period.
Limit one (1) entry per person during the Giveaway Period. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, or any other methods will void all of that entrant's entries and that entrant may be disqualified.
ELECTRONIC COMMUNICATIONS:
Visiting the Site or sending emails to Company constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
PRIZE(S):
Three winner will receive one surprise piece of Jewelry, with a maximum retail value of $258. No cash or other substitution of prizes is permitted, except at the sole discretion of Company. The prize(s) are non-transferable. Prize award is subject to verification of eligibility and compliance with these Official Rules. ALL FEDERAL, STATE AND LOCAL TAXES AND COSTS ASSOCIATED WITH ACCEPTANCE AND USE OF PRIZE NOT SET FORTH IN THESE RULES ARE THE OBLIGATION OF THE WINNER. No assignment, transfer or substitution of any Prize is permitted by the Winner. Participants agree that if a Winner is found to have violated these Official Rules, or otherwise does not meet the eligibility criteria, such Prize will be forfeited and awarded to an alternate Winner in a random drawing from among all remaining Entries. Company reserves the right to substitute any Prize for a different prize of equal or greater value, in its sole discretion.
NO PURCHASE NECESSARY:
No purchase is no purchase is necessary to enter or win this Giveaway. A purchase will not improve the chances of winning. Odds of winning will depend on the total number of eligible entries received as of the applicable drawing date deadline stated within these Giveaway terms.
USAGE CHARGES:
Normal internet access or device usage charges imposed by mobile carriers may apply to Entries submitted via mobile device. Messaging and data rates apply to internet access via mobile devices. Other charges may apply; check with the applicable mobile carrier for rates/details. Consent may not be a condition of purchase or imposition of messaging, data rates and other charges imposed by mobile carriers.
NON-DELIVERY:
Company is not responsible for any undelivered messages, emails or any other communications, including but not limited to those that are not received because of the potential winner’s privacy or spam filter settings that may divert any notification or other Giveaway related email to a spam or junk folder. Company is not responsible for any incorrect or inaccurate information, whether caused by website users, human error, tampering, hacking or by any of the equipment or programming associated with or utilized in the Giveaway and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission (including availability or accessibility of the internet), incompatibility, communications failure, theft, loss or destruction of Entries, nor for the failure to capture Entry or other information.
NOT SPONSORED:
The Giveaway is not sponsored in any way by any social media platform utilized in this giveaway. You understand that all information is being provided to Company and not to Facebook, Instagram, Twitter, YouTube, Google or any other social media where this Giveaway may be promoted, advertised or otherwise used to disseminate information relating to the Giveaway. Company is not responsible for practices, terms or actions taken by any of these or other social media and web services sites. You understand that you are required to comply with terms and conditions of those social media platforms.
WINNER SELECTION AND NOTIFICATION:
Arizona governs the time zone for this giveaway. The giveaway entry period is Saturday November 25th beginning at 2.30 pm to 5.30 pm on Monday November 27th. Any entry received prior to or after the giveaway entry period will be disqualified. The winner will be selected at random. On November 27th, the Company will select the winner at random among all eligible entries received during the giveaway period. The potential winner(s) will be notified by Instagram story tag/direct message within 1 day following the end of the Giveaway Period. If a potential winner cannot be contacted within 2 days or fails to respond within the designated time, that potential winner may be disqualified, and an alternate winner may be selected.
PUBLICITY RELEASE:
By participating in the Giveaway you grant (and agree to confirm that grant in writing, if necessary) Company the right to use your Entry, including any likeness, image, voice, and statements contained therein, for promotion, trade, commercial, and publicity purposes, at any time or times, in all media now known or hereafter discovered, including television, Internet and social media, worldwide, without notice, review or approval and without additional compensation, except where prohibited by law.
MATERIALS PROVIDED TO THE SITE OR POSTED ON ANY COMPANY WEBPAGE
Company does not claim ownership of the materials you provide, post, upload, input or submit to the Site or Company’s associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting Company permission to use your Submission in connection with the operation of Company’s businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission, per the terms in the Publicity Release section in this document.
No compensation will be paid with respect to the use of your Submission, as provided herein. Company is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in Company’s sole discretion.
GOVERNING LAW:
This Agreement shall be governed by and construed in accordance with the laws of the state of Arizona, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be instituted in the state and federal courts located in the state of Arizona, and each party submits to the jurisdiction of such courts, with the Company and the entrant agreeing that all actions will be bro9ught in the state and federal courts located in the state of [insert state].
DISPUTE RESOLUTION:
Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the state and federal courts located in the state of Arizona.
SEVERABILITY:
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. In such event, the invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely achieves the intent and economic effect of the invalid or unenforceable provision.
INDEMNIFICATION:
By participating in the giveaway, each entrant agrees to indemnify, defend, and hold harmless Company, its affiliates, subsidiaries, officers, directors, employees, agents, and representatives from and against any and all claims, demands, suits, actions, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with any breach of these Terms and Conditions, including but not limited to any violation of eligibility criteria, misrepresentation, or infringement of intellectual property rights.
By participating in the giveaway, each entrant acknowledges that they have read, understood, and agree to abide by these Terms and Conditions, including the Indemnification clause.
LIMITATION OF LIABILITY:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY, ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOSS OF DATA, LOSS OF USE, OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH THE GIVEAWAY, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL COMPANY'S TOTAL LIABILITY TO ANY ENTRANT FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE GIVEAWAY EXCEED THECOST OF THE PRIZE WON BY THE ENTRANT.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
COMPANY SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, OR INJURY TO ANY ENTRANT'S COMPUTER, MOBILE DEVICE, OR OTHER EQUIPMENT RESULTING FROM DOWNLOADING OR USING ANY MATERIALS RELATED TO THE GIVEAWAY.
THE LIMITATIONS OF LIABILITY SET FORTH HEREIN ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND THE ENTRANTS.
THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
FORCE MAJEURE:
Company shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions to the extent that such failure or delay is caused by an event or circumstance beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, natural disasters, interruptions in internet or telecommunication services, or any other event or circumstance that is unforeseeable and beyond the control of Company ("Force Majeure Event"). In the event of a Force Majeure Event, Company shall be excused from performance and shall have the right to suspend, delay, or terminate the Giveaway without any liability or obligation to the participants. Company shall make reasonable efforts to notify the participants of any such Force Majeure Event and the impact on the Giveaway.

Your use of the Site is subject to Company’s Website Terms and Conditions and Privacy Policy. Please review our Terms and Conditions and Privacy Policy at the footer of our site, which also governs the Site and informs users of our data collection practices. By using our website, you agree to our privacy policy and terms & services. Please read these terms carefully before using our site or services.
ENTIRE AGREEMENT:
These Terms and Conditions, together with any additional clauses or sections as specified herein, constitute the entire agreement between Company and the entrants pertaining to the subject matter hereof, and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written. Company reserves the right, in its sole discretion, to change the Terms under which the Giveaway is offered. The most current version of the Terms will supersede all previous versions. Company encourages you to periodically review the Terms to stay informed of our updates.
